Trump Asks US Supreme Court to Restore Refugee Travel Ban

The Supreme Court is scheduled to hear arguments October 10 on President Donald Trump's overall travel order, which imposed a 90-day ban on people entering the US from six mostly Muslim countries and a 120-day ban on refugees, to give officials time to assess vetting procedures. The appellate ruling could take effect as soon as Tuesday and could apply to up to 24,000 refugees.

The Justice Department's high court filing Monday follows an appeals court ruling last week that would allow refugees to enter the United States if a resettlement agency in the USA had agreed to accept their case. The Supreme Court in July largely upheld that ruling, though it put on hold the portion dealing with refugees.

As per Justice Anthony Kennedy, a part of the decision lies in a court of Hawaii that is due on Tuesday, September 12.

Mr. Trump's order halts entry into the United States by citizens of the six banned countries for 90 days and suspends refugee admissions for 120 days.

The U.S. Supreme Court ruled that Trump's ban could be implemented on a limited basis, but should not be applied to people with "bona fide" relationships to people or entities in the United States. That filing, by Acting Solicitor General Jeffrey Wall, demonstrated the lengths to which the government is willing to go to impose its desired version of the ban, even before the high court takes up in earnest next month whether the measure is lawful at its core.

Both provisions were blocked by lower courts but were partially revived by the Supreme Court in June.

But the 9th Circuit last week ruled that refugees a USA resettlement agency has committed to providing services for once they have arrived in the country should be exempt from Trump's order. Nor can the exclusion of an assured refugee plausibly be thought to "burden' a resettlement agency in the relevant sense", Wall wrote in the request to the Supreme Court for a stay. The ban, plagued by legal challenges, had failed to take effect until that point.

Initially, the Trump administration tried to define who counts as a close family member very narrowly - excluding relatives such as grandparents, aunts, uncles, and cousins.
