10-year old rape victim delivers baby, is unaware she's a mother

Rape victim's sovereignty over her body should be respected SC

A 10-year-old rape victim in India who was denied permission to have an abortion has given birth to a baby girl a month on from the controversial Supreme Court verdict. The victim was raped for months by her maternal uncle, who has two daughters of the age of the victim. Instead, she was told that her expanding stomach was due to "a big stone" inside of her.

"The girl delivered a baby through C-section this morning", Dr Dasari Harish, who heads the panel constituted to treat the girl, said.

The victim had lost the legal battle after the top court refused to allow termination of her 32-week-old pregnancy, relying on a medical report that it would not be good for her or the foetus.

The incident was reported when the girl complained of stomach ache on July 15.

The girl, who was refused the right to have an abortion by India's Supreme Court, is in stable condition, according to reports.

"If you abort then the risk to life is greater", the superintendent said. Her father had requested the hospital authorities that the newborn be put up for adoption.

Indian law prevents termination beyond the 20th week.

India recorded 20,000 cases of rape of sexual assault on minors in 2015, according to government figures.

The woman then moved Patna High Court through YMNA in April, but the court refused to allow the termination after a medical board examined and opined that it could be risky to her life. In that case, the girl's stepfather allegedly raped her.

Kumari said: "Whatever be the circumstances in which the child was conceived, whatever the trauma of the young mother, the fact remains that the child is also not to blame for being conceived". The decision was based on a panel of doctors from the Government Medical College and Hospital, the hospital superintendent told The Washington Post at the time. "The child is innocent, just like the victim, its mother".
