In a huge setback for Congress president Sonia Gandhi and her son Rahul, the Delhi High Court ordered income tax probe in the National Herald case.

The Young Indian Private Limited has Congress chief Sonia Gandhi and party vice-president Rahul Gandhi as directors. The firm withdrew its petition, after a bench of justices, comprising S Muralidhar and Chander Shekhar, asked the company to approach the Income Tax assessing officer.

The High Court also said that the company can not be arrogant and will have to submit their documents to the Income Tax department, a report on CNN News18 said.

Firstly, the case was opened for investigation by Delhi's Patiala House Court which had been challenged in the Delhi High court.

In his complaint, he alleged that Congress granted an interest-free loan of Rs 90.25 crore to AJL, owner of the National Herald newspaper established by Jawaharlal Nehru.

"We are not inclined to entertain your writ petition".

The plea had sought quashing of two Income Tax notices sent to YI in January and March with regard to the assessment year 2011-12. They were summoned by the trial court for the alleged offences of dishonest misappropriation of property, criminal breach of trust, cheating and criminal conspiracy. But, the fact that they said that they gave loans to National Herald for running the paper was from the Congress Party's funds.

The IT department's move to issue the notices followed its probe on Swamy's complaint alleging that the Gandhis had misappropriated AJL's assets while transferring their shares to the newly formed Young India. "Subramanian Swamy is not inchare of I-T", Surjewala said.

Speaking to CNN-News18, BJP leader and Rajya Sabha member Subramanian Swamy said that these cases will see the light of day. On 19 December, 2015, it had granted bail to Sonia Gandhi, Rahul Gandhi, Vora, Fernandes and Dubey, who had appeared before it pursuant to summons. The trial court has fixed the next hearing on May 15 regarding the summoning of further documents in the case.

On 12 February 2016, the Supreme Court granted exemption to all the five accused in the case from personal appearances while refusing to quash proceedings against them.
